Terms

Requirements. You must mark the centerline of the proposed driveway before the permit can be approved. The marking can be painted, be tape at the top of a stake, or a ribbon. The marking must be easy for the Road Supervisor to identify.
  • Work shall not begin until the permit is approved. A hard copy or electronic version displayed on a mobile device of the approved permit must be on the work site during active construction operations. Absence of the permit on the work site may result in the construction activity being shut down. The permit will expire at one (1) year from the date of approval if no work has occurred. The permit fee and deposit will not be refunded for expired permits. The Permittee shall ensure all land use laws and ordinances, as well as all environmental laws and regulations (including wetland regulations), are complied with for the location, placement and construction of the driveway. PLEASE NOTE, St. Louis County may not be the only governmental entity with land use authority for your location. Please check with your local government (City, Township, etc.) to ensure compliance with all of their requirements PRIOR TO SUBMITTING THIS APPLICATION. St. Louis County does not provide a culvert or other materials needed to construct the driveway. The standard residential driveway width is 20 feet. The standard commercial driveway width is 32 feet. No foreign material, such as dirt, gravel or asphalt, shall be deposited on the County Road surface at any time. The Permittee shall ensure adequate Erosion Sediment Control (ESC) Best Management Practices (BMPs) are utilized for the permitted scope of the work. St. Louis County reserves the right to require corrective action related to ESC. If the Permittee fails to undertake corrective action within 24 hours of verbal notification, St. Louis County will report any deficiencies to the Minnesota Pollution Control Agency in accordance with Minnesota Rules 7053.0205 Subp. 2. Any release of material that may cause pollution, may be environmentally damaging, may be hazardous, is petroleum based, or in the event of a pipeline break, must be reported to the State Duty Officer in accordance with Minnesota Statute 115.061. In the event the State Duty Officer is notified, the Permittee shall also notify St. Louis County within 24 hours of occurrence of the discharge. The sides of the driveway shall slope away at a minimum of 1:3 (1 foot of fall for every 3 feet horizontal). The driveway surface shall slope down and away from the County Road for a distance of at least 15 feet with a fall of at least 3 inches. Vertical culvert ends, such as constructed of concrete, masonry or rocks, are not allowed. The ditch and roadside must be cleaned up after the work is completed. The request for inspection must be submitted through the Permittee's online permit account to schedule final inspection and approval of completed work. St. Louis County will not issue a refund of the deposit until all terms of the permit are completed, and the ditch and roadside are cleaned up to the satisfaction of St. Louis County.
